TERMS OF SALE

Webstore www.lavatera.ee (hereinafter referred to as the “Webstore”) is owned by Lavatera OÜ (registration code 14569838), located at Pärnu mnt 62b-5, Sindi town, 86703 Tori parish, Pärnu county.

Validity of the Sales Contract, Product and Price Information

The terms of sale apply when purchasing goods from the Webstore.

The prices of products sold in the Webstore are indicated next to the products. The price includes a fee for the delivery of the goods. All prices for goods sold in the Webstore are in euros.

The delivery fee depends on the buyer’s location and the method of delivery. The delivery fee is displayed to the buyer when placing the order.

Product information is provided directly next to the product in the Webstore.

Placing an Order

To order a product, the desired items must be added to the shopping cart. To place an order, the required fields must be filled in, and a suitable delivery method must be selected. The amount to be paid will then be displayed on the screen, which can be paid securely through the following payment methods:

  • Estonian bank payments
  • Finnish bank payments
  • Latvian bank payments
  • Lithuanian bank payments
  • Visa/Mastercard card payments

NB! When paying by bank transfer, be sure to click the “Return to the merchant” button on the bank’s page.

Payments are processed by Maksekeskus AS. Payment is made outside the Webstore in a secure environment – when paying by bank transfer, in the secure environment of the respective bank, and when paying by credit card, in the secure environment of Maksekeskus AS. The seller does not have access to the customer’s bank or credit card details. The contract becomes effective upon receipt of the payment to the Webstore’s account.

The owner of the Webstore is the responsible processor of personal data and transmits the necessary personal data for payment processing to the authorized processor Maksekeskus AS.

If the ordered product cannot be delivered due to the product being out of stock or for other reasons, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded without delay, but no later than 14 days from the date of notification.

Delivery

Goods are shipped to the following countries: Estonia, Latvia, Lithuania, Finland

The buyer has the following options for receiving the goods:

  • Omniva parcel machine
  • DPD parcel machine
  • SmartPost parcel machine

The buyer bears the shipping costs, and the corresponding price information is displayed next to the shipping method.

Domestic shipments within Estonia generally reach the buyer’s specified destination within 7 working days from the effective date of the sales contract. Delivery outside Estonia takes place within 21 calendar days.

In exceptional cases, the right to deliver goods within 45 calendar days is reserved.

Right of Withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-store within 14 days, provided that the packaging has not been opened.

The right of withdrawal does not apply if the buyer is a legal entity.

To use the 14-day right of withdrawal, the ordered product must not be used in any way other than what is necessary to ascertain the nature, characteristics, and functioning of the product, as is permitted for testing the product in a physical store.

If the product has been used for purposes other than what is necessary to ascertain the nature, characteristics, and functioning of the product, or if it shows signs of use or wear, the Webstore has the right to reduce the refund amount according to the decrease in the product’s value.

The desire to return the product must be communicated by email to info@lavatera.ee no later than 14 days after receiving the product.

The buyer bears the return shipping costs, except in cases where the reason for the return is that the product to be returned does not correspond to the order (e.g., wrong or defective product).

The buyer must return the product within 14 days of submitting the return request or provide proof that the product has been handed over to the carrier within the aforementioned period.

Upon receipt of the returned product, the Webstore will refund the buyer without delay, but no later than 14 days from the receipt of the withdrawal request, all payments received from the buyer under the contract.

The Webstore may refuse to make refunds until it has received the item subject to the contract or until the buyer has provided proof of having sent the item back, whichever occurs first.

If the buyer has explicitly chosen a delivery method offered by the Webstore that differs from the least expensive standard delivery method, the Webstore is not obliged to refund the consumer for costs exceeding those associated with the standard delivery method.

The Webstore has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the product in the Webstore has been mistakenly marked significantly below the market price of the product.

Right to Submit Claims

The Webstore is responsible to the buyer for any non-conformity or defect in the sold product that existed at the time of delivery and becomes apparent within two years from the date of delivery to the buyer. Within one year from the date of delivery to the buyer, it is presumed that the defect existed at the time of delivery. The Webstore is obliged to rebut this presumption.

The buyer has the right to contact the Webstore within two months of the defect becoming apparent by sending an email to info@lavatera.ee or calling +372 5649 8488.

The Webstore is not responsible for defects that arise after the product has been delivered to the buyer.

If the product purchased from the Webstore has defects for which the Webstore is responsible, the Webstore will repair or replace the defective product. If the product cannot be repaired or replaced, the Webstore will refund all payments made under the sales contract.

The Webstore will respond to consumer complaints in writing or in a form allowing for written reproduction within 15 days.

Direct Marketing and Personal Data Processing

The Webstore uses the personal data provided by the buyer only for processing the order and sending the product to the buyer. The Webstore transmits personal data to companies providing delivery services to deliver the product.

The Webstore sends newsletters and offers to the buyer’s email address only if the buyer has expressed a desire to do so by entering their email address on the website and indicating their wish to receive direct marketing communications.

The buyer can unsubscribe from receiving offers and newsletters at any time by notifying us via email or following the instructions provided in the email containing the offers.

Dispute Resolution

If the buyer has any claims against the Webstore, they should be sent to info@lavatera.ee or call +372 5649 8488.

If the buyer and the Webstore cannot resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The terms of the procedure can be found and the application submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract between the buyer and the Webstore. The review of the buyer’s complaint by the committee is free of charge.

The buyer may also turn to the European Union’s consumer dispute resolution platform.
